They don't have to get back packs out (though they often do, even if its just to drop them when they start running).  But you do have a point, Eric and Jeremy might be dumb enough to keep there's until they get passed and then decide to get ride of the luggage.

As for who outraces who.  The only time we have seen the Hippies being faster is in the first episode getting to their packs.

Oh, I just realized something.  If the leg is a TBC one and Eric and Jeremy hit the mat first.  I will be happy of course, but I will be pissed off as well.

Offically Eric and Jeremy ahve won 5 legs.  But in any other year (except the last two) they would have really already won 6 legs.  If it happens again tonight it will not offically count.

Since they are driving themselves and are not in a cab I don't think they'll bother grabbing the backpacks -- espcially since they are all aware it will be a footrace.
