To the penalty. When it happened to Rob & Amber (not to mention Gretchen & Meredith and Ray & Deana) it was 4 hours starting when the next team arrived at the roadblock.
But in season 6, in the next to last leg (it was the last episode). Hayden and Aaron were the last teams to arrive at the roadblock and after not finding the right lock and the place about to close Hayden asked aaron what would happen. And its they take a 4 hour penalty. Now of course that Aaron so what does he know.
But at the Mat, Phil does tell them that they have been penalized 4 hours (and really 1 minute is enough to let Adam & Rebecca check in official as team #3.
So based on scenes in season 6 and 7, It appears if you aren't last to the roadblock its 4 hours plus (starting when the next team arrives at the roadblock). But if you are last at the roadblock its just 4 hours.
Which does make sense. If a team has a huge starting advantage (either from luck, a strong previous leg, or a strong current leg) it doesn't give them the option of just saying hey we have 4 hours lets just not to the roadblock.
