Five orphans have gotten the go-ahead from California's Court of Appeals to sue ABC and "Extreme Makeover: Home Edition" for their eviction from their house.

The five Higgins, ranging in age from 14 to 21, were featured on the reality show on Easter of last year showing the "Extreme Makeover" renovation of the house belonging to the Leomitis family, the New York Post reported Monday.

The two families had attended the same church and the five-member Leomitis family took the orphans in after their parents died.

When the "Extreme Makeover" crew was finished, the small, cramped house had nine bedrooms -- one for each child in the home. However, shortly after the work was finished, the Leomitis family evicted the Higgins, the newspaper said.

ABC told the orphans it could not help them because the 24-page contract they signed did not give them any legal rights to the new home. The network also claimed the contract required them to take any complaints about the show to arbitration rather than through the court system.

In rejecting the arbitration clause in the contract, the appellate panel used words like "unconscionable" and "unenforceable," the Post said.
Because sometimes the way to feel good about yourself is by making someone else feel bad. I am tired of making others feel good about themselves.

so i'm assuming the Higgins couldn't work it out with the Leomitis and therefore is going after ABC....

the reason why the kicked them out...hmmm...there is more to this story I bet....they both go to the same church.

I wonder if the Higgin's kids where particpating in some behavior the Leomitis dissaproved of...just a thought.

Its pretty sad how inconsiderate people can be.

Greed thats what drives some people...whats going to happen now? ABC will buy them land and build a house for them??

Love the show but obviously people just went on that episode for their 15minutes of fame!!!

I cannot watch EM without bawling at the end. (Or maybe even in the middle.) However, they do go out and find subjects for the show that inspire this type of feeling in the viewer.

A friend who participated in a show here in Texas pointed out to me that while they updated a building for a small town, the cost for upkeep will be more than the the town can afford. A catch-22.  :(

Is it anything like 'Pimp my Ride', where after the work is done, it's almost ridiculous? Or the car is just asking to be stolen?

more i think about it I think the E! network would love this...i'm going to see if they have a place on their website to suggest this type of show..I'd watch it
